WASHINGTON — New York Attorney General Letitia James on Friday asked a federal judge to dismiss a mortgage fraud case against her, calling it a politically motivated effort orchestrated by President Donald Trump in retaliation for her past civil fraud lawsuit against him. James’ motion accuses the administration of pursuing a “vindictive prosecution” fueled by Trump’s personal hostility.
James’ lawyers cited years of public insults by Trump and his allies, arguing the charges stem from “targeted attacks” following her successful civil case that found Trump had committed fraud, even though an appeals court later overturned the more than $500 million fine. Prosecutors allege James falsified information on mortgage documents for a home in Norfolk, Virginia, a claim she denies.
Her attorneys contend the Justice Department selectively pursued her case while ignoring similar discrepancies involving Trump allies such as Texas Attorney General Ken Paxton. They also questioned the appointment of U.S. Attorney Lindsey Halligan, a former White House aide named after her predecessor, Erik Siebert, was pushed out.
James pleaded not guilty last month, saying the case reflects the administration’s use of the justice system “as a tool of revenge.” She is the first woman elected as New York’s attorney general.
