Washington, DC — President Donald Trump said Friday he will issue an executive order requiring voter identification in the upcoming midterm elections if Congress does not pass legislation mandating it.
In social media posts, Trump declared, “There will be Voter I.D. for the Midterm Elections, whether approved by Congress or not!” He added that if lawmakers fail to act, he would present legal arguments in support of unilateral action. The comments come as House Republicans advance the SAVE America Act, which would require documentary proof of citizenship to register for federal elections and impose new restrictions on mail-in ballots.
The Constitution grants states primary authority over the “times, places, and manner” of federal elections, though Congress can regulate them. Legal scholars told NBC News that a presidential order mandating voter ID nationwide would likely face constitutional challenges. Stanford law professor Nate Persily said the Constitution “doesn’t give unilateral regulatory authority for election to the president.” A federal judge in January permanently blocked a prior Trump executive order that sought to alter election procedures.
The SAVE America Act passed the House largely along party lines and now faces a 60-vote hurdle in the Senate. Democrats argue the measure could disenfranchise eligible voters, while supporters say it strengthens election integrity.
