Several leading medical organizations, including the American Academy of Pediatrics and the American Public Health Association, filed suit Monday against Health Secretary Robert F. Kennedy Jr., accusing him of unlawfully removing pregnant women and healthy children from the federal COVID-19 vaccine schedule.

The lawsuit, filed in federal court in Massachusetts, claims Kennedy’s May decision was “arbitrary and capricious” and violated federal law requiring input from the Advisory Committee on Immunization Practices (ACIP), which Kennedy disbanded and repopulated with his own appointees.

“This action threatens our nation’s vaccine infrastructure,” said Dr. Susan Kressly, AAP president. One anonymous plaintiff, a pregnant physician, fears she may now be unable to access vaccination.

A Health and Human Services spokesperson said Kennedy “stands by his CDC reforms.” Legal experts note the case hinges on violations of the Administrative Procedure Act, which governs how public health guidelines are changed.

The plaintiffs are asking the court to reverse Kennedy’s vaccine policy changes and declare them unlawful.
