Philadelphia District Attorney Larry Krasner is suing Elon Musk and his PAC, America PAC, seeking to halt a daily $1 million giveaway targeting registered voters. Krasner argues that the initiative, which offers Pennsylvania voters $100 for signing a political petition and a chance to win $1 million, is an unregulated lottery under Pennsylvania law. The lawsuit claims this “lottery” tactic circumvents regulations, describing it as “indisputably an unlawful lottery” that requires state oversight.

Musk’s PAC started the giveaways to encourage signatures supporting First and Second Amendment rights. In response, the DOJ warned Musk that offering financial incentives tied to voter engagement might violate federal law, which prohibits paying individuals to vote. Musk defended the giveaways, insisting they’re not tied to voter registration or voting but merely support constitutional rights. Despite federal warnings, Musk maintains his initiative is lawful, clarifying that it’s a “petition in support of the Constitution.”

America PAC has not commented on the lawsuit.
