At a Philadelphia hearing on Monday, a lawyer for Elon Musk’s America PAC acknowledged that winners of its $1 million-a-day sweepstakes in swing states are not chosen randomly, but instead are selected to serve as “spokespeople” for the PAC. GOP attorney Chris Gober confirmed that Monday and Tuesday’s recipients would be from Arizona and Michigan, not affecting the Pennsylvania election.
Philadelphia District Attorney Larry Krasner, who testified at the hearing, argued the sweepstakes constitutes an illegal lottery under Pennsylvania law, citing the lack of published rules and potential misuse of participants’ personal information. Krasner called the contest a “scam” and questioned the validity of the prize checks, presented by Musk himself.
Musk’s team asserted that the sweepstakes will not continue beyond Election Day. However, Krasner emphasized the ongoing investigation and the possibility of criminal charges for alleged violations of Pennsylvania lottery laws, which aim to protect voter information and election integrity. The lawsuit proceeds under Common Pleas Court Judge Angelo Foglietta after an attempt to transfer it to federal court was denied.
