U.S. District Judge Lee Rudofsky issued a preliminary injunction against Arkansas’ ban on “indoctrination” in public schools, allowing two high school teachers to discuss critical race theory (CRT) in the classroom. The ban, part of an education overhaul signed into law by Republican Gov. Sarah Huckabee Sanders, is being challenged by two teachers and two students at Little Rock Central High School.

Rudofsky’s ruling prevents the state from disciplining teachers for teaching, mentioning, or discussing CRT, an academic framework that posits racism is embedded in the nation’s institutions. However, the ruling still bars teachers from grading based on a student’s acceptance or rejection of a theory.

Both the state and the teachers’ attorneys claimed the ruling as an initial victory in ongoing litigation over the law. Critics argue that the ban is so vague it forces teachers to self-censor to avoid violation. Arkansas is among several Republican-led states that have imposed restrictions on how race is taught in classrooms.
