ATLANTA, Georgia — A court-ordered affidavit unsealed Tuesday reveals the FBI’s justification for its January raid seizing nearly 700 boxes of ballots and voting records from Fulton County’s 2020 election operations.

The affidavit states the investigation originated from a referral by Kurt Olsen, a former temporary White House employee involved in post-2020 election litigation efforts. The document outlines allegations regarding ballot scanning discrepancies and record retention practices. Georgia Secretary of State Brad Raffensperger described the claims as “baseless and repackaged,” noting that similar assertions had previously been investigated and rejected.

Among the issues cited, the affidavit points to missing scanned ballot images from the original count and recount. However, Georgia law at the time did not require retention of those images. The FBI also referenced instances of ballots being scanned multiple times during a machine recount, though prior state investigations found no evidence of fraud and confirmed that duplicate scans did not result in double counting.

Legal experts have questioned whether the affidavit sufficiently established probable cause, particularly if potentially exculpatory information was omitted. Fulton County officials are seeking return of the seized materials, arguing the warrant relied on theories previously dismissed in court.

The case adds to ongoing legal and political disputes surrounding 2020 election claims and federal oversight of election procedures in Georgia.
