WASHINGTON, DC — The Trump administration has proposed a rule that would eliminate gender identity protections in federally funded housing and shelters, potentially reshaping access rules nationwide.
The Department of Housing and Urban Development (HUD) plans to remove references to “gender identity” and replace them with a definition based on biological sex. The change would reverse an Obama-era rule designed to ensure equal access to housing regardless of gender identity.
The proposal would also allow operators of single-sex shelters to require documentation or other evidence to verify a person’s sex before granting access. Federal officials argue the change would standardize access based on what they describe as “immutable biological classification.”
Advocacy groups have criticized the proposal, warning it could increase barriers for transgender individuals seeking shelter or housing assistance. They argue the change may lead to higher rates of homelessness and strain local services.
The rule is open for public comment through June and is expected to face legal challenges, particularly from states that already enforce gender identity protections in housing laws.
