SAN FRANCISCO — A lawsuit has been filed challenging a San Francisco ordinance that creates a reparations fund for Black residents. The measure, signed in December by Mayor Daniel Lurie, is intended to address what city officials describe as systemic harms.
The Pacific Legal Foundation (PLF) filed the suit in San Francisco Superior Court on behalf of residents Richard “Richie” Greenberg, Arthur Ritchie, and the Californians for Equal Rights Foundation. PLF attorney Andrew Quinio argues the plan violates constitutional protections by treating residents differently based on race.
“You can’t treat people differently based on race,” Quinio said, contending the city is improperly using taxpayer funds to implement the program.
The ordinance follows recommendations from the African American Reparations Advisory Committee, established in 2020. In 2023, the committee proposed measures including potential one-time payments of $5 million, supplemental income, job and tuition assistance, and student loan relief.
The mayor’s office said it has not yet been served with the lawsuit and will review the complaint once received.
