A coalition of advocacy groups, including the National Education Association and the NAACP, filed a lawsuit Monday challenging President Donald Trump’s executive order to dismantle the U.S. Department of Education. The lawsuit claims Trump exceeded his constitutional authority and violated the Administrative Procedure Act.

“Defendants’ steps since January 20, 2025, constitute a de facto dismantling of the Department by executive fiat,” the complaint states. The plaintiffs argue that only Congress has the power to determine the creation and function of federal agencies.

The legal action follows Trump’s directive to Education Secretary Linda McMahon to eliminate as much of the department as legally possible. Soon after, Trump announced that federal student loans would move to the Small Business Administration, and special education and nutrition programs to the Department of Health and Human Services.

Since taking office, McMahon has cut the Education Department’s staff in half. Plaintiffs say the changes harm students, families, and communities.

“The effort is not only illegal; it inflicts great harm,” said Robert Kim, director of the Education Law Center.
