Former President Trump has proposed a one-year jail sentence for anyone desecrating the American flag. This follows anti-Israel protests over the Gaza war outside Washington, D.C.’s Union Station, where a group burned an American flag. On “Fox & Friends,” Trump dismissed those who cite constitutional protections for flag burning, labeling them as “stupid people.” He urged Congress to legislate the jail term, arguing it would deter such acts.

The Supreme Court’s 1989 Texas v. Johnson decision protected flag burning as free speech under the First Amendment. Both Republicans and Democrats condemned the Union Station protests, coinciding with Israeli Prime Minister Benjamin Netanyahu’s address to Congress. Protesters replaced an American flag with a Palestinian one and burned the U.S. flag before it was seized. D.C. police arrested six protesters, while additional arrests occurred during Netanyahu’s speech and subsequent march.

Netanyahu, in his speech, criticized the protesters, accusing them of supporting evil and stating they should be ashamed. Palestinian health authorities report over 38,000 Palestinian deaths in Gaza amid Israel’s military response to Hamas’ October 7 attacks, which resulted in over 1,000 Israeli deaths.
