The Mexican American Legal Defense and Educational Fund (MALDEF) announced Wednesday it is preparing a $1 million lawsuit on behalf of Job Garcia, a U.S. citizen detained after filming an Immigration and Customs Enforcement (ICE) and Border Patrol raid at a Home Depot in Los Angeles.
Garcia, 37, a photographer and Ph.D. student, says he was thrown to the ground, pinned by the back and neck, handcuffed, and held for over 24 hours after advising a truck driver of their legal rights. He claims agents never asked him to stop recording.
DHS Assistant Secretary Tricia McLaughlin alleges Garcia “assaulted and verbally harassed” an agent and will face prosecution. Garcia denies the accusation, calling the arrest retaliation for exercising his rights.
MALDEF alleges violations of Garcia’s First, Fourth, and Fifth Amendment rights and asserts the arrest was racially motivated. “The Trump Administration must be stopped in its campaign of terror against those who disagree with mass deportations,” said MALDEF counsel Ernest Herrera.
