Steve Bannon, the former Trump adviser, requested a federal appeals court in Washington to allow him to remain out of prison while he appeals his contempt of Congress convictions, possibly to the Supreme Court. Last week, Judge Carl Nichols ordered Bannon to begin a four-month prison sentence on July 1. The U.S. Court of Appeals for the District of Columbia Circuit had already rejected Bannon’s appeal in May.

In his emergency filing, Bannon referred to his case as “landmark” and cited “political realities” of serving a prison sentence before the 2024 election. Bannon was convicted on two counts of contempt of Congress in 2022 for refusing to comply with subpoenas from the House panel investigating the January 6 Capitol attack, citing executive privilege.

Bannon argued that his conviction discourages negotiation over subpoena compliance. The appeals court previously upheld the conviction, ruling executive privilege did not justify ignoring the subpoena. Judge Nichols had allowed Bannon to remain free during his appeal but now requires him to report to prison. Similar appeals by Peter Navarro, another Trump adviser, have been denied.
