Washington, D.C. — Health and Human Services Secretary Robert F. Kennedy Jr. is preparing a rule that could make it easier for people to receive compensation for certain injuries tied to COVID-19 vaccines or other pandemic countermeasures.
The proposed rule would create a COVID-19 Countermeasures Injury Table under the Countermeasures Injury Compensation Program, known as CICP. If an injury appears on the table and occurs within a listed time period, claimants could receive compensation without separately proving direct causation.
The rule has not been released, and HHS has not specified which injuries it may include. The federal regulatory agenda says the table would list injuries supported by “compelling, reliable, valid, medical, and scientific evidence.” Rare reactions to COVID-19 vaccines, including myocarditis and anaphylaxis, have been documented, though such injuries remain uncommon.
Kennedy’s role adds controversy because he has a long anti-vaccine record and has promoted false or misleading claims about vaccine safety. He founded Children’s Health Defense, which Media Bias/Fact Check rates as a Right Conspiracy-Pseudoscience source with Low factual reporting. AP has also reported that Kennedy rose to prominence during the COVID-19 pandemic through his opposition to vaccines.
Supporters of a narrow injury table say it could help people with legitimate claims. Critics warn that adding weakly supported conditions could politicize vaccine safety and erode trust in evidence-based public health decisions. The proposal is expected to be published in November.
