A group of retired U.S. military generals have voiced opposition to former President Donald Trump’s claim of presidential immunity, warning that it could disrupt military operations. Trump, facing four criminal cases including a significant federal case accusing him of attempting to overturn the 2020 presidential election results, claimed broad immunity from criminal prosecutions for actions taken during his presidency. This claim has been widely criticized by legal experts and denied by a Washington, D.C., appeals court. The U.S. Supreme Court will now rule on this matter.

In a filing submitted to the Supreme Court, retired generals from the U.S. Army, Navy, and Air Force condemned Trump’s immunity claims. They expressed deep interest in the case, stating that presidential immunity from criminal prosecution could threaten the military’s role in American society, national security, and the nation’s constitutional order. They warned that such immunity could disrupt the rule of law, critical to the military’s mission and public trust in the armed forces, and could potentially damage public trust in the military and the willingness of recruits to join the armed forces.

Former federal prosecutor Andrew Weissmann suggested that while he doesn’t believe the courts will grant Trump presidential immunity, Trump could use pardon power if he wins reelection.
