Rep. Joseph Morelle (D-N.Y.) introduced a constitutional amendment aiming to overturn a recent Supreme Court decision granting former presidents presumptive criminal immunity for official acts. Morelle criticized the decision, stating it undermines the foundational principle that no American is above the law.
The proposed amendment clarifies that no official can claim immunity for criminal actions based solely on their official duties. The Supreme Court’s 6-3 decision, favoring former President Trump, established that presidents have absolute immunity for core responsibilities and presumptive immunity for other official acts. The case was remanded to a lower court to determine if Trump’s actions related to the January 6, 2021, Capitol riot are protected.
Critics argue the decision contradicts the founders’ intent, asserting that presidents should not be above the law. Morelle emphasized that presidents are neither monarchs nor tyrants and must be accountable to the same legal standards as all citizens.
