A federal judge has ordered the Trump administration to return a Maryland man who was mistakenly deported to El Salvador. U.S. District Judge Paula Xinis ruled Friday that Kilmar Abrego Garcia was removed from the United States “without legal basis” and must be brought back no later than 11:59 p.m. on April 7.

Abrego Garcia was deported on March 15 on one of three flights that federal authorities said were transporting alleged members of the MS-13 and Tren de Aragua gangs. The deportations followed Trump’s invocation of the Alien Enemies Act in response to what the administration called an invasion by gang affiliates.

Immigration and Customs Enforcement said the removal was “an oversight,” citing a final removal order and claims of Abrego Garcia’s MS-13 ties. However, a judge had granted him asylum in 2019.

The Justice Department maintains he poses a threat to the community, despite the court ruling.
