Former Secretary of State Hillary Clinton warned that the Supreme Court could soon overturn Obergefell v. Hodges, the 2015 decision that legalized same-sex marriage nationwide. Speaking on the podcast Raging Moderates, hosted by Fox News’ Jessica Tarlov and Scott Galloway, Clinton compared the potential ruling to the court’s 2022 reversal of Roe v. Wade.

“It took 50 years to overturn Roe v. Wade,” Clinton said. “The Supreme Court will hear a case about gay marriage; my prediction is they will do to gay marriage what they did to abortion — they will send it back to the states.” She advised same-sex couples to consider marrying soon, adding, “I don’t think they’ll undo existing marriages, but I fear they will undo the national right.”

The warning comes after Kim Davis, the Kentucky clerk jailed in 2015 for refusing to issue marriage licenses to same-sex couples, petitioned the court to revisit Obergefell. The justices have not announced whether they will take the case.

While the 2022 Respect for Marriage Act requires states to recognize marriages performed elsewhere, it would not eliminate dormant state bans if Obergefell is struck down. Justices Clarence Thomas and Samuel Alito have both criticized the ruling, citing conflicts with religious liberty.
