A prominent Democratic election lawyer, Scott Salmon, has filed a lawsuit asserting that Robert F. Kennedy Jr. is ineligible to appear on New Jersey’s presidential ballot as an independent candidate. Salmon argues that Kennedy’s switch from a Democratic to an independent candidacy violates the state’s “sore loser law,” which prohibits candidates who previously sought a party nomination from running independently.
Salmon, known for past successful challenges, highlighted Kennedy’s initial Democratic campaign and fundraising activities in New Jersey as grounds for disqualification under the law. Kennedy’s campaign contends that it has submitted sufficient signatures to qualify for the ballot, though the legality of the petition remains under review until late July.
Salmon emphasized on social media that his legal action is self-funded and not driven by Democratic interests, stating his belief that enforcing election laws is paramount. Kennedy’s team has yet to publicly respond to the lawsuit.
