California lawmakers have proposed two bills to secure abortion access ahead of President-elect Trump’s return to the White House. One bill protects providers and distributors of abortion medications, such as mifepristone, from civil or criminal liability, even if federal restrictions are enacted. The other bill would allow the state Attorney General to fine local governments that obstruct abortion providers from operating.

California Attorney General Rob Bonta reaffirmed the state’s commitment to reproductive rights, stating, “California will remain a safe haven for reproductive rights and access to abortion care, no matter who is in the White House.”

Trump previously stated he would not use the 1873 Comstock Act to ban mailing abortion drugs, saying the federal government should stay out of the issue. However, this stance angered some conservatives, and abortion-rights advocates remain skeptical, fearing the law could be revived under his administration.

The Biden DOJ has interpreted the Comstock Act as applying only when materials are intended for illegal abortions, complicating its potential enforcement. Despite this, activists worry about future restrictions on medication abortion.
