President Biden will propose term limits for Supreme Court justices and a constitutional amendment to counteract the recent presidential immunity decision. During a speech at the LBJ Presidential Library, Biden will also support a binding code of conduct for the justices.

“No one is above the law,” Biden wrote in a Washington Post op-ed, marking a shift after resisting Supreme Court reforms.

Biden’s proposals respond to the court’s decisions to overturn constitutional abortion protections and grant criminal immunity to former presidents. He will call for a constitutional amendment clarifying that former presidents do not have immunity for federal crimes, dubbing it the “No One Is Above the Law Amendment.”

“It would make clear that there is no immunity for crimes a former president committed while in office,” Biden emphasized.

Biden will also propose 18-year term limits for justices, allowing new appointments every two years, ensuring regular changes, and reducing undue influence. Additionally, he will endorse a binding code of conduct for justices, advocating for mandatory gift disclosures and recusal in conflicts of interest cases.

Justice Elena Kagan recently supported an enforcement mechanism for the ethics code.
