Former President Donald Trump’s attorneys have proposed an August 12 start date for his federal trial regarding mishandled classified documents, despite their efforts to delay the proceedings. This suggestion was made in response to Judge Aileen Cannon’s directive for scheduling proposals in the case, which also involves Mar-a-Lago property manager Carlos De Oliveira. For co-defendant Walt Nauta, Trump’s assistant, a September 9 start date was proposed.
Trump’s legal team continues to argue that a fair trial cannot be held this year, especially given Trump’s position as a leading Republican candidate in the upcoming general election. They have raised concerns about the constitutionality of conducting the trial this year and accused the government of pushing for a hastened trial.
Special Counsel Jack Smith, in contrast, has requested a July 8 trial date for all three defendants, aiming to conclude the trial before the November 5 election. This comes amid Trump’s broader strategy to postpone his four pending federal trials, which include charges under the Espionage Act from an FBI raid at his Mar-a-Lago estate. The raid uncovered classified documents retained from his presidency.
Trump’s defense has filed motions to dismiss the charges based on claims of presidential immunity, challenges to the constitutionality of the Espionage Act, allegations of an unlawful appointment of Special Counsel Jack Smith, and arguments under the Presidential Records Act. Despite these legal maneuvers, the Supreme Court has agreed to consider Trump’s claim of presidential immunity, which could influence the timing of the classified documents trial. Trump has pleaded not guilty to 37 felony charges, including over 30 violations of the Espionage Act.
