WASHINGTON, D.C. — Lawyers for Rep. Eric Swalwell are demanding the FBI halt plans to release records from a decade-old investigation, escalating tensions over the handling of sensitive federal files.
Swalwell’s attorneys sent a cease-and-desist letter to FBI Director Kash Patel, arguing that releasing the records would violate federal law and longstanding Justice Department policy. The investigation, which examined Swalwell’s interactions with a suspected Chinese operative, concluded without criminal charges.
The attorneys warned that making the files public could expose the FBI to legal liability and demanded confirmation within three days that the agency would comply. They also indicated legal action would follow if the records are released.
The controversy follows reports that FBI officials have been reviewing and redacting documents in preparation for possible disclosure. Such releases are considered unusual when investigations do not result in charges.
Swalwell, who is currently running for governor of California, has denied wrongdoing and previously cooperated with investigators. A House Ethics Committee inquiry into the matter also ended without action.
