A federal judge on Monday denied Hunter Biden’s attempt to dismiss tax charges against him, clearing the way for his trial to begin next month in California. Biden’s lawyers had argued for dismissal, citing a Florida ruling that tossed out a separate prosecution of former President Trump due to the alleged improper appointment of a special counsel.

U.S. District Judge Mark Scarsi rejected this argument, stating there was “no valid basis for reconsideration” of the case, which accuses Hunter Biden of a four-year scheme to avoid paying $1.4 million in taxes. Scarsi, appointed by Trump, had previously dismissed a challenge to the appointment of special counsel David Weiss.

Hunter Biden’s lawyers were admonished by the judge for “false statements” in court filings but were not sanctioned after amending their submission. A hearing is scheduled for Wednesday to discuss the admissibility of evidence in the upcoming trial.

This marks Biden’s second criminal trial in recent months, following his June conviction on three felony charges related to a 2018 gun purchase.
