A federal judge in Delaware has declined to dismiss gun charges against Hunter Biden, son of President Joe Biden. U.S. District Judge Maryellen Noreika ruled against Hunter Biden’s request to dismiss two counts of lying about his use of illegal narcotics when purchasing a handgun in 2018 and a third count of illegally possessing that weapon. This ruling paves the way for a trial on the gun charges, tentatively scheduled to start on June 3.
Hunter Biden’s legal team had argued for the dismissal of the gun charges on several grounds, including the claim that the law under which he was charged was likely unconstitutional following a 2022 U.S. Supreme Court ruling that expanded gun rights. They also argued that Special Counsel David Weiss was not appropriately appointed, that Hunter Biden was being selectively prosecuted, and that he had a binding agreement shielding him from prosecution.
In addition to the gun charges, Hunter Biden has also pleaded not guilty to federal tax crimes in a separate case brought by Weiss in California. He faces up to 17 years in prison if convicted in this case, with the trial scheduled to start on June 20.
