WASHINGTON, D.C. — Two former FBI agents have filed a federal lawsuit alleging they were wrongfully terminated due to their involvement in a 2020 election-related investigation tied to Donald Trump. The case adds to growing legal challenges surrounding personnel decisions within the bureau under current leadership.
The agents, who filed anonymously, claim they were dismissed by FBI Director Kash Patel in late 2025 after being assigned to “Arctic Frost,” an investigation into alleged efforts to overturn the 2020 election. According to the lawsuit, both agents had strong performance records and were given no formal explanation, hearing, or internal review prior to their termination.
The complaint alleges the firings violated the agents’ First Amendment rights to free speech and Fifth Amendment rights to due process. It also claims the agents had limited, largely administrative roles in the investigation and were not accused of misconduct.
Patel has denied allegations of political retaliation, telling lawmakers he removed employees he believed were “weaponizing” federal law enforcement. The FBI has declined public comment on the lawsuit.
The agents are seeking reinstatement and a judicial declaration that their constitutional rights were violated. The case follows broader scrutiny over the handling of investigations connected to the 2020 election and subsequent personnel actions.
