Madison, Wisconsin — The Wisconsin Elections Commission has referred two complaints involving Elon Musk’s 2025 election payments to prosecutors after finding probable cause that he violated state election bribery laws.
The Associated Press reported that the bipartisan commission voted 5-1 in a closed session to send the complaints to Brown County District Attorney David Lasee. Prosecutors now have 40 days to report back to the commission on whether they will pursue charges.
The complaints involve Musk’s offer of $1 million payments to voters during Wisconsin’s 2025 Supreme Court election. Musk appeared at a Green Bay rally backing Republican-supported candidate Brad Schimel, who lost to Democratic-supported candidate Susan Crawford.
According to AP, the commission found probable cause that Musk broke state law by offering $1 million to people who voted in the election “in order to induce them to vote.” Musk gave checks to three Wisconsin voters, including two at the Green Bay event.
Musk’s attorneys previously argued that the payments were protected political speech and were intended to build opposition to “activist judges,” not to support or oppose a specific candidate.
