Tye, Texas — A Taylor County child abandonment case is moving forward after authorities said a 3-year-old was found alone outside an apartment complex while the child’s mother was away.

Court documents cited by KTXS state that Justice Moncibaiz, of Tye, was indicted after police said she left the child unattended at an apartment complex in September. Officers were called after neighbors reportedly found the child sitting at the bottom of a staircase wearing a soiled diaper.

Investigators said officers located an unlocked apartment believed to be connected to the child, but no adult was inside. Police reportedly found mail addressed to Moncibaiz in the apartment, helping identify a possible resident.

Authorities said Moncibaiz arrived about 40 minutes after officers contacted her. Police said she initially told investigators she had left the child with a relative, but she could not provide contact information for that person.

According to investigators, Moncibaiz later admitted she “needed a night out” and had gone to a couple of bars with a friend.

Moncibaiz was arrested and charged with abandoning a child with intent to return. The case will now proceed through the Taylor County court system.
