The Department of Justice’s Office of the Inspector General released an 88-page report concluding there were no undercover FBI agents on the National Mall or in the Capitol on January 6, 2021. This finding counters claims that FBI agents incited the riot during protests spurred by then-President Trump’s call for supporters to march to the Capitol.
The report acknowledged that some confidential human sources (CHSs) were present, including three tasked with monitoring domestic terrorism subjects. None were authorized to enter restricted areas or commit illegal acts, nor were they directed to incite others to do so. Additional findings revealed 23 CHSs attended the rally, with four entering the Capitol and 13 entering restricted perimeters; none have faced prosecution.
The investigation criticized the FBI for inadequate intelligence-gathering efforts before the riot. Despite recognizing the potential for violence, the bureau did not sufficiently canvass field offices to collect intelligence from informants, a step the report suggested could have bolstered preparations.
The FBI, while disagreeing with some findings, stated its commitment to assessing and improving policies for handling major events.
