New York, New York — President Donald Trump lost another attempt Friday to move his New York hush money case into federal court, leaving his 34-count felony conviction intact while his state appeal continues.
U.S. District Judge Alvin Hellerstein rejected Trump’s renewed request to transfer the case from state court, ruling that the arguments presented were “neither new nor legally sufficient.”
Trump was convicted in May 2024 of 34 felony counts of falsifying business records connected to a $130,000 payment made to adult-film actor Stormy Daniels before the 2016 presidential election. Prosecutors argued the records were falsified to conceal the payment’s purpose.
Hellerstein had previously denied Trump’s efforts to move the case into federal court. The latest review came after a federal appeals court instructed him to reconsider the request in light of the Supreme Court’s 2024 ruling expanding presidential immunity for official acts.
The judge concluded that Trump had not shown sufficient grounds to revisit the earlier decision and criticized the effort during February arguments as seeking “two bites at the apple.”
The ruling marks the third time Trump has failed to remove the case from New York state court.
Trump continues to challenge the conviction through the state appellate process, where his attorneys are separately seeking to overturn the verdict.
