The Trump administration is preparing to revive Title 42, a pandemic-era border policy that allows U.S. immigration officials to expel migrants on public health grounds, according to internal government documents obtained by CBS News.
The proposed order, issued under the Public Health Service Act, would classify unauthorized migrants as public health risks, citing diseases such as tuberculosis. Customs and Border Protection (CBP) agents would be directed to expel migrants without processing them under federal immigration law, denying them the right to seek asylum.
This move builds on President Donald Trump’s broader crackdown on immigration, which has included mass deportations and the use of 212(f) authority to bar migrants deemed “detrimental” to the U.S. While migrant crossings have dropped by over 90% since Trump took office in January, officials are still moving forward with stricter enforcement measures.
The policy is expected to face legal challenges, as courts previously ruled that Title 42 could not override U.S. asylum laws. Critics argue the order is more about restricting immigration than public health protection.
