The Trump administration petitioned the Supreme Court on Thursday for an emergency intervention to limit lower court rulings that have blocked President Donald Trump’s executive order restricting birthright citizenship.
The Justice Department is not yet requesting a full ruling on the constitutionality of the order but is seeking to narrow the scope of nationwide injunctions issued by three federal appeals courts. Acting Solicitor General Sarah Harris argued that the lower courts overstepped their authority by issuing rulings affecting all individuals rather than just the plaintiffs in the cases.
Trump’s executive order, signed on his first day back in office, aims to exclude children born in the U.S. to parents without permanent legal status from automatic citizenship under the 14th Amendment. The move has triggered 10 lawsuits, with challenges citing Supreme Court precedent that broadly protects birthright citizenship.
This marks the third time the administration has sought an emergency ruling from the Supreme Court, following previous requests regarding foreign aid freezes and removal of agency officials. The court has previously declined to establish clear limits on nationwide injunctions.
