John Anthony Castro, a Texas man known for filing multiple challenges to former President Trump’s ballot eligibility, was arrested Tuesday on charges related to filing false tax documents. Castro, who is also a 2024 GOP presidential candidate, faces 33 counts of aiding in the preparation of false tax returns. Prosecutors allege that through his virtual tax preparation business, he defrauded the government by promising clients significantly higher refunds than other preparers could offer, often without the taxpayers’ knowledge.
According to the prosecution, Castro generated fraudulent deductions to inflate refunds. He was caught by an undercover officer, to whom he promised a $6,007 refund compared to the $373 estimated by a reputable preparer. Castro allegedly filed tax forms for the officer containing nearly $30,000 in false deductions.
Castro’s legal challenges to Trump’s eligibility, based on the Jan. 6 Capitol riots and the 14th Amendment, have been filed in 27 states. While many have been dismissed, including recent ones in Florida, Nevada, and New Hampshire, others in Colorado and Maine have succeeded, with the Supreme Court set to review the Colorado case.
Castro has dismissed the tax fraud charges as politically motivated, asserting his innocence and claiming the indictment is retaliation for his challenges against Trump. He mentioned a settlement with the IRS in 2021, where his firm repaid about $700,000 over discrepancies. Castro emphasized his determination to prove his innocence in court and raised concerns about the indictment’s timing, which he links to his political actions against Trump.
He is scheduled to appear in court again on January 17.
