The U.S. Supreme Court on Thursday rejected an emergency appeal from the Trump administration, upholding a lower court order requiring the government to help return Kilmar Abrego Garcia, a Maryland man mistakenly deported to a prison in El Salvador.

Abrego Garcia, 29, had a court order preventing his removal due to credible fears of persecution by local gangs. Despite this, he was deported last month. The administration admitted the error but argued it could no longer act to reverse it.

The justices, without noted dissent, said the administration must “facilitate” his release and share what steps it is taking to bring him back. The Court stressed this must not intrude on executive authority over foreign affairs.

Justice Sonia Sotomayor, joined by two colleagues, condemned the government’s claim it lacked recourse, warning it implied any person—even U.S. citizens—could be deported without consequence.

Abrego Garcia, a legal worker with no criminal record, was wrongfully accused of MS-13 affiliation without evidence.
