The U.S. Supreme Court declined to hear a challenge by Save Jobs USA against a rule allowing spouses of H-1B visa holders to work legally in the United States. The 2015 Obama-era regulation enables H-4 visa holders, typically spouses of skilled foreign workers, to obtain employment authorization.
The decision leaves intact the D.C. Circuit Court’s ruling that upheld the Department of Homeland Security’s authority to issue the rule. In fiscal year 2024, DHS approved over 25,000 H-4 work visa applications.
The ruling comes as President Donald Trump’s administration introduced a controversial $100,000 fee on businesses seeking new H-1B workers, a policy facing legal challenges from several unions. Critics of the H-4 rule argue it disadvantages U.S. workers, while supporters say it strengthens family stability and retention of skilled labor.
