Special Counsel Jack Smith formally resigned from the Department of Justice (DOJ) on January 10, following the submission of his confidential final report days earlier. Smith, appointed by Attorney General Merrick Garland in 2022, oversaw investigations into former President Trump’s handling of classified documents and efforts to overturn the 2020 election.

Trump’s re-election complicated Smith’s cases, as DOJ policy prevents prosecuting sitting presidents. Florida Judge Aileen Cannon dismissed charges in the Mar-a-Lago case, citing Smith’s “unlawful” appointment, a ruling DOJ is appealing. Meanwhile, the Supreme Court ruled former presidents have immunity from prosecution, slowing progress in the January 6 case.

Trump and his co-defendants are now fighting to block Smith’s reports. The DOJ plans to release the January 6 volume but not the Mar-a-Lago findings, citing ongoing litigation. Trump’s upcoming inauguration may prevent Smith’s work from becoming public.
