San Diego, California — A high school student’s suspension has been overturned after he was disciplined for posting flyers supporting immigration enforcement, raising questions about student free speech rights.
The 17-year-old student at Torrey Pines High School was suspended for one day after placing flyers reading “We heart ICE” on campus. School officials reportedly characterized the messages as “demonizing and hateful,” though the student argued he was expressing a political viewpoint.
Represented by an attorney from the Foundation for Individual Rights and Expression, the student challenged the suspension as a violation of his First Amendment rights. His legal team noted that other students had previously participated in anti-ICE protests without disciplinary action.
Following a request for records related to the case, the San Dieguito Union High School District reversed course and expunged the suspension from the student’s record. The district maintained it does not discipline students based on political beliefs but enforces rules related to harassment and discrimination.
The student said he felt “relieved and vindicated,” adding that the initial punishment raised concerns about unequal treatment of differing viewpoints.
