A federal judge warned the Trump administration on Wednesday that deporting non-citizens to Libya would violate an existing court order. U.S. District Judge Brian Murphy, a Biden appointee, said there is “no doubt” the reported removals would breach his April injunction.
Murphy had previously ordered that immigrants and their lawyers receive advance notice and the opportunity to challenge deportations to countries where they may face persecution. A separate April 30 ruling also bars the use of other federal agencies, including the Department of Defense, to carry out deportations in violation of the injunction.
“Plaintiffs are simply asking to be told they are going to be deported… and be given an opportunity to explain why,” Murphy wrote. “This small modicum of process is mandated by the Constitution.”
According to legal filings, immigrants from Laos, Vietnam, and the Philippines were slated for removal to Libya, a nation with well-documented human rights abuses. Media reports suggest Libyan authorities have refused to accept deportation flights.
