A federal judge has sharply criticized the Trump administration for obstructing court orders related to the deportation of Kilmar Abrego Garcia, a Salvadoran national and alleged MS-13 member deported last month despite a judicial “withholding order” prohibiting his removal to El Salvador.

Judge Paula Xinis of the U.S. District Court for Maryland condemned the administration’s refusal to disclose what steps it has taken to “facilitate” Abrego Garcia’s return as ordered by the Supreme Court. “Defendants have sought refuge behind vague and unsubstantiated assertions of privilege,” she wrote Tuesday, labeling the conduct as a “willful and bad faith refusal to comply.”

The Justice Department has until 6 p.m. Wednesday to justify its claims of privilege.

The ruling follows visits to El Salvador by House Democrats and Sen. Chris Van Hollen (D-MD) to advocate for Abrego Garcia’s release. President Nayib Bukele has refused to return him.
