Special Counsel Jack Smith formally exited the Mar-a-Lago documents case, handing over prosecution of President-elect Donald Trump’s co-defendants, Walt Nauta and Carlos de Oliveira, to federal prosecutors in Florida. Charges against Trump in both federal cases were dismissed in November due to Justice Department policy prohibiting prosecution of a sitting president, though they were dropped without prejudice.

Nauta and de Oliveira still face obstruction of justice and other charges tied to hiding classified records from investigators and Trump’s attorney. The case involves over 300 classified documents improperly retained by Trump after his presidency, some stored in unsecured areas like a ballroom and bathroom at his Florida residence.

The 11th Circuit Court of Appeals is reviewing an appeal against a ruling by Judge Aileen Cannon, who dismissed the case against Trump, citing Smith’s alleged improper appointment. The Justice Department argues her decision contradicts decades of precedent.
