An Iowa nursing home worker is suing her former employer, claiming she was fired after trying to report a resident’s agonizing death. Tylene Schultz filed the lawsuit in Pocahontas County District Court against Fonda Specialty Care, its parent company Care Initiatives, and nurse Becky Manning.
Schultz alleges she repeatedly asked Manning to suction the airway of 87-year-old resident Marvin “Pete” Jacobs, who had a tracheostomy. Manning allegedly refused more than 10 requests before Jacobs died during a February 2023 overnight shift. Schultz says she was told not to call 911 and later received text messages from her supervisor telling her to “keep your mouth shut.”
Manning pleaded guilty to misdemeanor wanton neglect and agreed to suspend her nursing license. The Iowa Department of Inspections cited the facility and imposed a $6,500 fine.
Schultz claims she was fired in retaliation for reporting Manning to regulators. Jacobs’ family filed a separate lawsuit, but a judge enforced a signed arbitration agreement, blocking court proceedings.
