A centrist Democratic think tank, Third Way, has accused independent presidential candidate Robert F. Kennedy Jr. and his supporting super PAC, American Values 2024, of illegal coordination in their efforts to secure Kennedy’s ballot access for the upcoming election. Third Way has raised concerns in Arizona, Georgia, and Michigan, urging state officials not to accept signatures collected by American Values 2024, alleging that such activities violate federal and state laws regarding campaign coordination and ballot submission processes.

American Values 2024 aims to invest at least $15 million and has hired canvassing firms to gather signatures in various states. However, Third Way, through attorneys from the Elias Law Group, argues that federal campaign finance laws require independence in these efforts, a stance seemingly contradicted by state laws mandating candidates themselves to submit nomination signatures.

Kennedy’s campaign insists on compliance with the law, emphasizing a volunteer-based approach for ballot access across all states, criticizing the Democratic efforts as an attack on democratic principles. Meanwhile, Tony Lyons, president of the super PAC and Kennedy’s book publisher, defends their actions as a First Amendment right, referencing legal precedents supporting their case.
