Treasury Secretary Scott Bessent warned Sunday that the U.S. may have to refund half the tariffs collected under President Trump’s trade agenda if the Supreme Court strikes them down. Speaking on NBC’s Meet the Press, Bessent expressed confidence in a favorable ruling but acknowledged the financial risk.
“If the court says it, we’d have to do it,” Bessent said, calling a potential refund “terrible for the Treasury.” The Supreme Court is reviewing a challenge after a lower court ruled Trump’s use of emergency powers to impose tariffs was unconstitutional.
Trump’s administration argues the tariffs are essential to preserving U.S. economic strength and deterring foreign threats. Solicitor General D. John Sauer said overturning the tariffs would leave America vulnerable to trade retaliation.
Trump has framed the case as a defining moment for his economic legacy, warning the country is “on the brink of economic catastrophe” if the High Court rules against him.
