SALT LAKE CITY, Utah — Salt Lake County District Attorney Sim Gill announced Friday that his office will not file criminal charges against Tim Ballard, founder of Operation Underground Railroad, citing “insufficient admissible evidence.” The decision follows a two-year investigation into sexual assault allegations made by multiple women, several of whom filed ongoing civil suits.
Prosecutor Clint Heiner from the Utah Attorney General’s office informed the parties of the decision, saying the standard for prosecution requires evidence that eliminates every reasonable doubt. Gill said the case could be reopened if new information emerges.
Ballard, who rose to prominence through the 2023 hit film Sound of Freedom, has denied wrongdoing and filed a defamation lawsuit against his accusers. He resigned from the organization in June 2023 following an internal board demand, and the Church of Jesus Christ of Latter-day Saints issued a public rebuke months later.
Civil litigation continues, including a suit by Celeste Borys. Ballard’s latest documentary, Hidden War, premiered Friday, the same day the declination decision was announced.
