Duxbury, Massachusetts — Rep. Nancy Mace, R-S.C., called for the execution of Lindsay Clancy after the Massachusetts mother’s murder trial ended in a mistrial, even though capital punishment is not available under Massachusetts law.
During an interview with TMZ, Mace said Clancy deserved a “public execution” and mentioned either a firearm or the electric chair. Her comments followed the Sept. 4 mistrial in Clancy’s case, where jurors deadlocked after seven days of deliberations. Multiple jurors later said the panel stood 11-1 in favor of finding Clancy not criminally responsible because of insanity.
Clancy admitted killing her three children — Cora, 5, Dawson, 3, and Callan, 8 months — in January 2023. Her defense argued she was suffering from postpartum psychosis. Prosecutors contended that she remained legally responsible for the killings.
Clancy’s attorney, Kevin Reddington, has since asked the judge to acquit her rather than allow a second trial. Prosecutors have not yet announced whether they will retry the case. If convicted of first-degree murder, Clancy could face life imprisonment without parole.
A presidential pardon is not available because Clancy faces state, not federal, charges.
Massachusetts has not carried out an execution since 1947, and its Supreme Judicial Court ruled the state’s death penalty unconstitutional in 1984. That means Mace’s proposed punishment could not be imposed under current Massachusetts law.
