Boston, Massachusetts — Florida Gov. Ron DeSantis said Friday that Florida would provide “asylum” to the lone holdout juror in the Lindsay Clancy murder trial if he is being harassed, after NBC10 Boston published a report examining allegations from the juror’s personal history.
The trial ended in a mistrial after jurors could not unanimously decide whether Clancy, who admitted killing her three young children in 2023, was criminally responsible because of postpartum psychosis. Eleven jurors reportedly favored a not-guilty-by-reason-of-insanity verdict, while one juror held out.
NBC10 later reported that the unnamed juror had previously faced domestic violence allegations, had been subject to a restraining order and was involved in an eviction dispute. The report prompted criticism from commentators who questioned whether examining his background after the mistrial unfairly targeted him, particularly because he is Black.
DeSantis accused NBC of trying to “smear” the juror and wrote that his identity should remain protected. “If the juror is being harassed, Florida will provide asylum,” he said.
Other jurors have separately criticized the holdout’s conduct during deliberations, saying he acknowledged reasonable doubt but still refused to support an insanity acquittal.
Clancy’s attorney has since asked the judge to enter a not-guilty finding rather than permit a retrial. That request remains pending.
