AUSTIN, Texas — An Immigration and Customs Enforcement agent shot and seriously wounded a 28-year-old Venezuelan man Sunday during an immigration enforcement operation, prompting demands from Austin officials for an independent investigation.
Wilber Rafael Garces Perez was shot in the torso following what Austin Police Chief Lisa Davis described as a brief foot pursuit. He was taken to a hospital in serious but stable condition before being transferred to federal custody. ICE says Garces Perez has a final removal order, while an attorney representing his family disputes parts of the government’s account and says he entered the United States legally.
Accounts of the encounter remain disputed. Austin City Council Member Mike Siegel said the ICE agent rammed Garces Perez’s Toyota Corolla before opening fire. Photographs from the scene showed bullet damage to the vehicle, but federal authorities have not publicly released a detailed account establishing exactly what preceded the shooting.
Austin Mayor Kirk Watson and Democratic Rep. Greg Casar called for Austin police and the Texas Rangers to participate in the investigation. Homeland Security Investigations is leading the federal inquiry with FBI assistance.
The shooting comes amid increased ICE activity nationwide, with the agency recording nearly 51,000 arrests in August.
