MCALLEN, TX — The family of an 8-year-old Honduran girl who died in U.S. border custody has filed a wrongful death lawsuit against the federal government, alleging medical neglect during her detention.

According to reporting from Associated Press, Anadith Danay Reyes Alvarez died in 2023 after being held for eight days at Border Patrol facilities in Texas. The lawsuit claims medical staff failed to act despite clear warning signs, including a fever that reached 104.9 degrees, nausea, and difficulty breathing.

An internal investigation by U.S. Customs and Border Protection found that medical personnel did not properly review documents provided by the child’s mother outlining serious preexisting conditions, including a heart disorder and sickle cell anemia. The suit alleges the girl was not taken to a hospital until her condition became critical.

Her father, Rossel Reyes Martinez, said the legal action is intended to prevent similar incidents, stating the family wants accountability for what occurred. The lawsuit follows a previously denied administrative claim filed in 2025.

The Department of Homeland Security has not publicly responded to the lawsuit. The case adds to ongoing scrutiny of medical care and detention conditions for migrants held at the southern border.
