Austin, TX — Elon Musk and his political action committee have agreed to settle two lawsuits accusing them of misleading voters with promises of $1 million payments tied to election-related petitions and turnout efforts.

The proposed settlements cover class-action cases brought by Arizona residents Jacqueline McAferty and Joy Harvick. The plaintiffs alleged that Musk and America PAC promoted the 2024 giveaway as a random chance to win $1 million after signing a petition supporting free speech and gun rights, while in reality potential recipients were vetted and selected.

The giveaway was part of Musk’s broader effort to help elect Donald Trump in 2024.

Musk later used a similar tactic during Wisconsin’s 2025 Supreme Court race, promising two $1 million checks to voters who participated in an event supporting Republican-backed candidate Brad Schimel.

A Wisconsin prosecutor declined to bring election-bribery charges against Musk, despite an earlier finding by the state elections commission that his conduct may have violated state law.

The settlement terms remain confidential and still require approval from a federal judge.

The cases are ending as Musk continues to play an outsized role in Republican politics. He has contributed more than $275 million toward GOP efforts ahead of the 2026 midterms, making him the largest known individual donor in the current cycle.
