Kansas officials are refusing to allow gender marker changes on driver’s licenses despite a recent Court of Appeals ruling that lifted an injunction against such updates. The Kansas Department of Revenue, under direction from Attorney General Kris Kobach, said no changes will be processed while the ruling is under appeal.
Jessie Lawson, a 43-year-old trans woman, was turned away from a license office in Andover after arriving early Monday to request an update following Friday’s ruling. “It’s embarrassing,” she said, calling the state’s decision “hurtful” and “bogus.”
Kobach’s office said the state has 30 days to appeal and intends to take the case to the Kansas Supreme Court. The appeals court’s ruling reversed a lower court’s injunction but did not decide the case’s core legal question, which will now be reconsidered.
Kansas had allowed gender marker changes since 2007, but a 2023 law mandated biological sex recognition. Kobach sued after the policy continued under that law.
